Terms of Participation and Waiver of Liability

By participating in any activity involving the use of the Monocz device (“Device”) and engaging with related digital experiences (“Tap-to-Engage Services”), you agree to the following terms:

1. Consent to Communications

By opting in, you consent to receive digital communications, promotions, and updates from Cool Opticz, its sponsors, partners, venue operators, and their affiliates. You may withdraw your consent at any time using the unsubscribe link provided in communications.

2. Assumption of Risk

You understand and agree that the use of the Device and participation in Tap-to-Engage Services may carry certain risks, including but not limited to distraction, physical strain, or interaction with third-party offers and content. You voluntarily assume all risks associated with such use.

3. Waiver and Release of Liability

To the fullest extent permitted by law, you hereby release, discharge, and hold harmless:

• its sponsors, partners, venue operators, affiliates, officers, employees, and agents,

from any and all claims, demands, liabilities, damages, or losses, whether known or unknown, arising out of or related to your use or misuse of the Device and Tap-to-Engage Services.

4. Indemnification

You agree to indemnify and defend Cool Opticz, its sponsors, partners, venue operators, and affiliates against any claims or demands made by third parties arising out of your use of the Device or Tap-to-Engage Services, your violation of these terms, or your violation of any applicable law.

5. Third-Party Services

Tap-to-Engage Services may link to third-party websites, promotions, or applications. Cool Opticz and its sponsors, partners, and venue operators are not responsible for the content, accuracy, or practices of such third parties. Participation in third-party promotions is at your own risk.

6. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the event or venue is located, without regard to conflict of law provisions.

Additional Terms for Gambling-Related Content

If you check the box “I am 21 years of age or older (or legal gambling age in my location),” you agree that:

• You may be presented with content, offers, or promotions from gaming or wagering partners such as BetMGM.

• Cool Opticz, its sponsors, partners, and venue operators are not responsible for your participation in third-party gaming activities, and you acknowledge that you participate at your own risk.

• You are solely responsible for complying with local laws regarding gambling or gaming activity.
